Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Exam Coach (“Service”), operated by Exam Coach (“we”, “our”, “us”). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By agreeing to these Terms you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@examcoach.io if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

3. Subscriptions and Billing

Exam Coach offers a free tier and paid subscription plans (“Pro”). Paid plans are billed monthly or annually in advance. All prices are displayed inclusive of any applicable taxes where required by law.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current paid period and you retain access until then.

We reserve the right to change subscription prices with at least 30 days' notice. Continued use after the price change takes effect constitutes acceptance.

4. Acceptable Use

You agree not to:

• Reproduce, redistribute, or resell any content from the Service without our written consent.
• Reverse-engineer, scrape, or extract data from the Service by automated means.
• Share your account credentials with others or allow multiple users to use a single account simultaneously.
• Use the Service to violate any applicable law or regulation.
• Attempt to gain unauthorised access to other users' accounts or our backend systems.
• Post or transmit any content that is unlawful, harmful, or infringes third-party rights.

5. Intellectual Property

All content on the Service — including study materials, knowledge graphs, scenario questions, flashcards, and software — is owned by Exam Coach or its licensors and is protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the content for personal study purposes only.

6. AI-Generated Content

The AI tutor feature generates responses using large language models. While we strive for accuracy, AI responses may contain errors or outdated information. Exam Coach content is for study assistance only and does not constitute professional or exam-guarantee advice. Always verify important information against official exam guides.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that using the Service will result in passing any certification exam.

8. Limitation of Liability

To the maximum extent permitted by law, Exam Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Delaware.

10. Changes to These Terms

We may revise these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the site. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
